Please read these Terms of Service ("Terms") carefully before using the Earnings BeatEdge mobile application operated by Nexcod Srl ("we", "us", "our").

By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

Earnings BeatEdge is a financial information application that provides:

Earnings Beat Screener — upcoming company earnings with beat-probability scores based on historical data, analyst sentiment, and industry correlation.
S&P 500 Earnings Tracker — historical price and earnings metric charts for SPY and sector ETFs.
Prediction market odds (Polymarket) related to upcoming earnings events.

Past beat rates and analyst estimates are not guarantees of future performance. Always consult an independent, licensed financial advisor before making investment decisions.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. The App is not intended to provide investment advice to retail investors under MiFID II or any equivalent regulation.

3. Free and Premium Access

Free tier: Access to earnings data for the next 2 trading sessions, SPY chart data, and basic metrics.

Premium tier (Earnings BeatEdge Pro): Unlocks all upcoming earnings beyond the next 2 sessions, all 11 SPDR sector ETFs, extended chart history, and forward estimates.

4. Subscriptions and Billing

Premium access is available through auto-renewable subscriptions:

Pro Monthly (ts_pro_monthly) — billed monthly.
Pro Yearly (ts_pro_yearly) — billed annually.

Subscriptions are managed and billed by the relevant app store (Apple App Store or Google Play). Prices are displayed in the App at the time of purchase and may vary by country.

Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation: You may cancel at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time.

Free trials: If a free trial is offered, any unused portion is forfeited when a subscription is purchased during the trial period.

5. Refund Policy

All purchases are processed by Apple or Google. Refund requests must be submitted directly to the relevant store in accordance with their refund policies:

6. Intellectual Property

All content, trademarks, algorithms, and software in the App are the property of Nexcod Srl or its licensors. You may not copy, distribute, modify, or create derivative works from any part of the App without our written permission.

7. Prohibited Use

You agree not to:

Reverse engineer, decompile, or extract the App's source code or algorithms.
Use the App for automated trading, algorithmic signals, or to build competing products without written permission.
Scrape or redistribute App data commercially.
Circumvent subscription gating through technical means.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. Financial data may be delayed or inaccurate. We are not responsible for any trading losses resulting from use of the App.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Nexcod Srl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of or inability to use the App.

10. Governing Law

These Terms are governed by the laws of Italy. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy, without regard to conflict of law provisions.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.
